REAL ESTATE AUCTION TERMS AND CONDITIONS

Auctioneer Role Disclaimer:

Brooks Legacy Estates & Auctions, LLC (hereinafter “Auctioneer”) is acting solely in the capacity of an independent bid caller/facilitator for the purposes of conducting this real estate auction. The Auctioneer does not represent the seller or any potential buyers as an agent, fiduciary, or advocate in this transaction. The Auctioneer’s role is limited strictly to facilitating the competitive bidding process and recording the outcome of the sale.

Auction Date & Time:

The real estate auction will be conducted on-site on Saturday August 2, 2025 at noon promptly.

Property Offered:

102 Saint Clair Rd. adjoining vacant lot and lake access, including covered dock with boat lift. So that this Here I am not representing the buyer I am not representing the seller. I am simply hired as a bid call

All information provided regarding the property, including but not limited to square footage, acreage, room count, and condition, is believed to be accurate but is not guaranteed. Prospective buyers must perform their own due diligence prior to bidding.

Partnership with Realtor:

This auction is conducted in conjunction with a licensed real estate professional who may assist in facilitating the post-auction purchase agreement. This arrangement does not constitute an agency relationship between the Auctioneer and any party involved in the transaction.

Registration Requirements:

All bidders must be registered no later than 15 minutes prior to the scheduled auction start time.

To register to bid, each prospective bidder must:

• Present a valid government-issued photo ID.

• Provide a current bank letter of credit or proof of sufficient funds indicating the ability to close within 30 days of the auction.

• Acknowledge and sign these Auction Terms and Conditions.

Buyer’s Premium and Earnest Money Deposit:

A 10% buyer’s premium will be added to the final bid amount and shall constitute the total contract price.

Immediately upon the fall of the hammer, the high bidder shall deliver a non-refundable earnest money deposit equal to 10% of the total contract price, payable by cashier’s check or bank-certified funds only.

Failure to provide the required earnest money at the time of sale may result in forfeiture of the bid and the property being offered to the next highest bidder.

Closing & Settlement:

Closing must occur within 30 calendar days of the auction date. Time is of the essence.

All closing costs, including deed preparation, attorney fees, title insurance, and recording fees, shall be the responsibility of the buyer unless otherwise agreed upon in writing.

If the buyer fails to close within the allotted time for any reason not caused by the seller, the earnest money deposit shall be forfeited.

Property Condition & Buyer Due Diligence:

The property is being sold “AS IS, WHERE IS, WITH ALL FAULTS” without warranty, representation, or guarantee of any kind, express or implied, by the seller, Auctioneer, or realtor.

It is solely the responsibility of the bidder/buyer to perform all inspections and investigate zoning, condition, and suitability of the property prior to the auction. Bidders are encouraged to seek professional advice and schedule property viewings in advance.

South Carolina Legal Disclosures:

• South Carolina law does not require the seller of residential property to provide a property condition disclosure if the sale is conducted via public auction.

• No contingencies of any kind, including but not limited to financing, inspections, or appraisal, will be allowed post-auction.

• The Auctioneer is licensed and bonded in the State of South Carolina but is not a licensed real estate broker and does not participate in real estate brokerage activity.

General Conditions:

• The Auctioneer reserves the right to reject any bid, to withdraw the property from sale at any time, or to cancel or postpone the auction without prior notice.

• The final bid is subject to seller confirmation unless otherwise stated.

• Announcements made on auction day take precedence over printed materials.

Acknowledgment:

By registering and placing a bid, the bidder affirms that they have read, understood, and agree to be bound by these Terms and Conditions.
