DESCRIPTION:REAL ESTATE AUCTION TERMS AND CONDITIONS \nAuctioneer Role Disclaimer: \nBrooks Legacy Estates & Auctions\, LLC (hereinafter “Auctioneer”) is acting solely in the capacity of an independent bid caller/facilitator for the purposes of conducting this real estate auction. The Auctioneer does not represent the seller or any potential buyers as an agent\, fiduciary\, or advocate in this transaction. The Auctioneer’s role is limited strictly to facilitating the competitive bidding process and recording the outcome of the sale. \nAuction Date & Time: \nThe real estate auction will be conducted on-site on Saturday August 2\, 2025 at noon promptly. \nProperty Offered: \n102 Saint Clair Rd. adjoining vacant lot and lake access\, including covered dock with boat lift. This arrangement does not constitute an agency relationship between the Auctioneer and any party involved in the transaction. \nRegistration Requirements: \nAll bidders must be registered no later than 15 minutes prior to the scheduled auction start time. \nTo register to bid\, each prospective bidder must: \n• Present a valid government-issued photo ID. \n• Provide a current bank letter of credit or proof of sufficient funds indicating the ability to close within 30 days of the auction. \n• Acknowledge and sign these Auction Terms and Conditions. \nBuyer’s Premium and Earnest Money Deposit: \nA 10% buyer’s premium will be added to the final bid amount and shall constitute the total contract price. \nImmediately upon the fall of the hammer\, the high bidder shall deliver a non-refundable earnest money deposit equal to 10% of the total contract price\, payable by cashier’s check or bank-certified funds only. \nFailure to provide the required earnest money at the time of sale may result in forfeiture of the bid and the property being offered to the next highest bidder. \nClosing & Settlement: \nClosing must occur within 30 calendar days of the auction date. Time is of the essence. \nAll closing costs\, including deed preparation\, attorney fees\, title insurance\, and recording fees\, shall be the responsibility of the buyer unless otherwise agreed upon in writing. \nIf the buyer fails to close within the allotted time for any reason not caused by the seller\, the earnest money deposit shall be forfeited. \nProperty Condition & Buyer Due Diligence: \nThe property is being sold “AS IS\, WHERE IS\, WITH ALL FAULTS” without warranty\, representation\, or guarantee of any kind\, express or implied\, by the seller\, Auctioneer\, or realtor. \nIt is solely the responsibility of the bidder/buyer to perform all inspections and investigate zoning\, condition\, and suitability of the property prior to the auction.
